Exemption status always is a major issue for political advocacy clients, who may not have internal professional staff familiar with the intricacies of IRS requirements. We educate our clients on best practices designed to avoid audits and other problems and we represent them aggressively if they are unfairly denied their exempt status. We have experience in federal election laws and reporting requirements and guide clients through this confusing area of compliance. Currently, we represent clients in a prominent case that challenges the IRS’ rejection of tax exempt status based on targeting them because of their political affiliation.
Served as Plaintiffs' co-counsel in federal lawsuit against the IRS and individual defendants for unconstitutional viewpoint discrimination against non-profit educational and advocacy groups. Agreeing to a declaratory judgement, Attorney General Jeff Sessions acknowledged that the conduct of the IRS “was wrong and should have never occurred.”
