The IRS denied fuel excise tax credits for industrial vacuum loaders known as “Guzzlers” used by an industrial waste removal company. The government recognized the hazards of litigating the case and agreed for purposes of this case that the equipment qualified as Off-Highway Vehicles engaged in an off-highway business use and, therefore, qualified for the fuel excise tax credit.
Represented a global bank in the workout of more than $1 billion in loans and real estate, including loan modifications, collateral foreclosures, and the sale of owned real estate.
Lead counsel to Georgia-based private fund in connection with acquisition and financing of $23.5 million multi-family portfolio of five properties in Tennessee and Georgia in 2015.
Defended nation’s leading provider of health care services in patent infringement litigation concerning electronic medical records systems. The case was ultimately dismissed with prejudice, with no payments from the client.
