IPLitigation
Clients trust us to enforce their valuable IP rights and defend them against infringement claims. The firm’s unique platform allows us to offer top-quality talent at a tremendous value for individuals (such as inventors, entrepreneurs, artists, and musicians) and businesses (ranging from Fortune 500 companies to start-ups), especially in high-stakes IP disputes.
Our IP litigation practice boasts former Am Law 100 attorneys, former judicial clerks from the U.S. Courts of Appeals for the Federal Circuit and the Eleventh Circuit, attorneys with technical degrees, and attorneys with significant industry experience. Team members routinely litigate against the largest and most expensive law firms and consistently deliver wins and favorable results for our clients.
We bring a wealth of litigation experience to courts throughout the country, representing clients in federal and state court (including appeals), in administrative proceedings, and in all the other key venues where IP disputes are resolved. For example, since 2012, our IP team headquartered in Atlanta, Georgia, has handled nearly 200 cases in over 30 jurisdictions, including courts in Delaware, California, Texas, New York, New Jersey, Georgia, Florida, Tennessee, South Carolina, North Carolina, Massachusetts, Connecticut, Virginia, and Wisconsin. Likewise, in more than 15 percent of all patent infringement cases filed in the Northern District of Georgia since 2016, in which both sides appeared, litigants selected us as their counsel.
As mindful practitioners, we make time to learn the unique circumstances of our clients, supporting them on the following matters:
- Patent Litigation
- Trademark, Trade Dress, and Unfair Competition Litigation
- Copyright Litigation
- Trade Secret Misappropriation
- Advertising, Marketing, and Promotions
- Anti-Counterfeiting and Brand Protection
- Arts, Entertainment, and Media
- Privacy and Data Security
- Licensing Disputes
- Internet-Related Disputes (Domain Names, Keyword Advertising)
- Patent Trial and Appeal Board (PTAB) Post-Grant Proceedings (IPRs, CBMs, PGRs)
- Trademark Trial and Appeal Board (TTAB) Proceedings (Appeals, Oppositions, Cancellations)
- International Trade Commission (Section 337) Proceedings
- Alternative Dispute Resolution (ADR) Proceedings (Mediation, Arbitration)
Our approach to all IP disputes is to understand our clients’ business goals for each matter, minimize litigation risks, achieve optimal results, and manage litigation costs. We strive to give clients the information they need to anticipate and manage IP litigation costs like other business expenses. We staff our cases for efficiency and subject-matter expertise, and most of our IP litigation attorneys have more than a decade of experience. Unlike traditional law firms, our innovative platform allows a seasoned lawyer to actively manage each case, using junior attorneys when appropriate. In short, we are committed to providing excellent client service and cost-conscious counsel to achieve success for our clients.
