"Intellectual Property Litigation," Georgia Business Litigation Book, Chapter, 2020 Edition

In the 2020 edition of the Georgia Business Litigation, a one-volume, comprehensive guide to matters business litigators will encounter, Jeffrey R. Kuester and Michael A. Cicero further updated their chapter titled “Intellectual Property Litigation.”

Published by ALM Media Properties, LLC, the Intellectual Property Litigation chapter includes new sections written by Mr. Cicero covering the “fair use” defense to trademark infringement actions. It also covers the preclusion of false advertising actions based on the Federal Food, Drug, and Cosmetic Act, and fraud on the Copyright Office as a copyright infringement defense. Additionally, it discusses 2017-2019 decisions from the Supreme Court involving patents, trademarks and copyrights, as well as from Georgia-based federal courts addressing those subjects.

The Intellectual Property Litigation chapter debuted in the 2016 edition of the publication and underwent updates for the 2017 and 2018 editions.
