On February 20, 2014, InsideCounsel published LeeAnn Jones and Jay Patton’s article, “Taming the Discovery Monster Through Effective Management.” The article discusses strategies in-house counsel should consider to take charge of what they can control and successfully navigate the discovery process. Jones and Patton suggest that in-house counsel should identify the key legal and factual issues, witnesses and documents at the outset; be proactive with preservation and collection; be consistent and responsive; and be strategic with discovery motions. Finally, common sense should guide in-house counsel as they work to ensure that the company’s case is not bogged down in costly discovery process that can add to the costs of litigation.
