"Is There a Rise in Class Actions for Construction Products?" Law360

In an article published by Law360 on March 8, 2016, Stephen L. Wright discusses a trend that suggests an increase in the availability of class actions in construction product defect cases. Mr. Wright identified and researched 25 recent decisions—almost all at the federal trial-level—involving products used in construction and the question of class action certification to see if there were consistencies that could be useful to companies involved in similar suits. The results suggest that there is not truly a trend—class action certification today is still granted only sparingly—but an evolution to a new jumping off point for possible expansion of class action use.
