Henry M. Quillian III used the powerful tool of the Georgia Racketeer Influenced and Corrupt Organization Act (RICO) to obtain a temporary restraining order and an interlocutory injunction freezing the assets of the embezzler to prevent the dissipation of the embezzler’s assets prior to the entry of a money judgment or restitution order against the embezzler. Well over $100,000 of value was preserved. An injunction can be obtained under this statute by the plaintiff/victim without having to prove that there is no adequate remedy at law – i.e., the plaintiff does not have to prove irreparable harm in the absence of the injunction.
