On June 22, 2015, Law360 turned to Jeffrey R. Kuester for comments on the U.S. Supreme Court’s ruling in Kimble v. Marvel Enterprises. The ruling leaves intact a 50-year-old rule barring royalty agreements that continue after a patent expires. Mr. Kuester suggests that patent attorneys sigh in collective relief to dodge another landmark change to patent jurisprudence. For more than 10 years, he says, the Court has ignored stare decisis. It is good news if such certainty is here to stay, leaving matters to Congress in the absence of clear negative impacts that would help revive predictability.
