Employee Benefit Plan Filing Deadlines for June and July
This alert follows up on the March 26, 2015 alert, titled “Employee Benefit Plan Filing Deadlines” regarding upcoming employee benefit plan deadlines. As a reminder, the following deadlines are the most common deadlines applicable generally to calendar year plans for June and July.
June 30: Deadline for processing corrective distributions for failed ADP/ACP test from a 401k plan with eligible automatic contribution arrangement without 10 percent excise tax.
July 15: Deadline for second quarterly contribution to applicable defined benefit plans (15 days after the end of the quarter).
July 29: Deadline (no later than 210 days after the end of the plan year) for distribution of summary of material modifications to summary plan description to participants and beneficiaries describing amendments made to the plan in the prior plan year.
July 31: Deadline for filing Form 8955-SSA unless extension is received by filing a Form 5558 (note that notice to separated participants with deferred vested benefits listed on such Form 5558 must be sent to such participants by the date Form 8955-SSA is filed).
July 31: Deadline for filing Form 5500 unless an extension is received by filing a Form 5558 (note that for corporations and controlled groups, where plan year and taxable year are same, the deadline is automatically extended to the corporate return due date).
July 31: Deadline for filing Form 5330 and paying the related excise taxes to the IRS related to, for example, late ADP/ACP plan test corrections or late deposit of employee deferrals, unless an extension applies.
July 31: Deadline for payment of fees by self-insured health plans to fund “Patient-Centered Outcome Research Institute (PCORI) Fee” by filing Form 720 with the IRS (insurer reports and pays for insured plans).
