Our energy and environmental clients include companies in the manufacturing, chemical, petroleum and natural gas, coal and coke, biomass and synthetic fuels, biodiesel and alcohol fuels, electrical power and steam generation, construction, engineering, real estate, forestry and forest products, agribusiness and energy crops, waste management and landfill methane, solar photovoltaic and thermal, wind energy, transportation, insurance, and financial industries.
Our environmental attorneys address all aspects of law involving contaminated properties. We regularly work with environmental scientists and engineers and assist our clients with the selection, retention, and efficient management of the appropriate environmental team for the project at hand.
We provide legal assistance regarding regulatory permitting, compliance, and enforcement issues involving all environmental media – air, water, and land – and through client alerts help keep our clients aware of new regulatory developments, trends, and concerns. We have a particular specialty in permitting and issues involving water management, whether raw water storage and withdrawal or process, waste, and storm water treatment and discharge are involved. Our attorneys track the emergence of climate change and carbon management law, regulation, and litigation and provide advice on opportunities and perils in those fields.
Our renewable energy practice is built upon the years of experience our attorneys have in the law surrounding energy tax credits, securities and complex financing transactions. We have been involved in more than 100 transactions involving renewable energy facilities including open-loop biomass, close-loop biomass, ethanol, wind, solar and other technologies. We have advised both project sponsors and investors in questions involving Section 48 investment tax credits, Section 45 production tax credits, accelerated depreciation and other renewable energy incentives. Many of these incentive programs were extended and expanded by the American Recovery and Reinvestment Act of 2009.
Drawing on our deep experience in securities and lending transactions, our renewable energy team is able to develop multi-tiered financing strategies that leverage project resources for the optimal mix of equity, debt and credit-leveraged financing. Our project finance lawyers and tax attorneys work together to achieve the financial goals of project sponsors, local government sponsors, equipment suppliers, debt investors and venture capitalists.
