Matthew Robert Rosenkoff is a member of the firm’s Litigation & Dispute Resolution and Employment, Labor & Immigration groups. Mr. Rosenkoff’s practice extends to all phases of commercial litigation. Specifically, Mr. Rosenkoff’s experience includes representing individuals, companies, and condominium/homeowners associations in litigation matters concerning, for example, contractual disputes; business torts; construction matters; labor and employment issues; real estate disputes; resort and hospitality disputes; and Fair Debt Collection Practices Act allegations.  Mr. Rosenkoff is licensed to practice law in Georgia as well as in Florida.  Mr. Rosenkoff has experience practicing in federal courts in both Georgia and Florida, before the Eleventh Circuit Court of Appeals, in appellate courts, and in American Arbitration Association proceedings.

Mr. Rosenkoff is also involved with the Emory Moot Court Society, having represented Emory’s Securities Team (as oralist and coach) and Emory’s National Team (as participant), and having served as a guest judge for recent law students.

Mr. Rosenkoff began practicing law as a litigation associate with Bilzin Sumberg Baena Price & Axelrod LLP (Miami, Fl.) and was most recently a litigation associate with Weinstock & Scavo, P.C. (Atlanta, Ga.).

Representative Transactions

  • Successfully represented Caribbean hospitality business in defeating a federal lawsuit by way of motion to dismiss for lack of jurisdiction (Southern District of Florida).
  • Successfully represented alleged debt collectors in defeating a federal Fair Debt Collection Practices Act and Georgia Fair Business Practices Act lawsuit on a motion to dismiss for failure to state a claim in federal district court (Northern District of Georgia) and on appeal in a Per Curiam Affirmed decision by the Eleventh Circuit Court of Appeals.
  • Successfully represented individual real estate broker and company and assisted in nonbinding arbitration resulting in a defense verdict of a residential real estate dispute involving allegations of fraud and breach of duty (Florida).
  • Assisted in trial and defense of client alleged to have violated the Fair Debt Collection Practices Act which resulted in the jury finding in favor of client (Georgia).
  • Successfully obtained summary judgment in a lawsuit involving breach of promissory notes and obtained satisfactory result for client through post judgment collection efforts (Florida).
  • Initiated effort which ultimately led to the Florida Legislature striking the derogatory term "shylock" from the usury laws of the Florida Statutes.
