Gregory G. Schultz is a member of the Firm’s Real Estate, Lending and Finance, Lending, Workout & Foreclosure, and Construction practice groups. His practice includes representing borrowers and lenders of all sizes in all areas of real estate, including in the acquisition, disposition, financing, development, leasing, subleasing and foreclosure of commercial, industrial and multi-family real estate.  He has represented clients in dozens of commercial real estate transactions including retail, multi-family and industrial real estate.  He also has represented numerous tenants and landlords in lease negotiations.

Mr. Schultz also has extensive experience in construction and real estate litigation, including with respect to title disputes, mechanic’s liens, construction defects, insurance coverage and special asset litigation. In particular, he has represented numerous policy holders and insurers in connection with insurance coverage disputes and contribution actions for defense and indemnity in numerous jurisdictions throughout the country including Alabama, Georgia, Iowa, North Carolina, Oregon, Texas and Pennsylvania. In connection with these proceedings, he has helped resolve construction claims in the tens of millions of dollars through contribution from insurance carriers and subcontractors. He has also successfully represented policyholders in first-party bad faith insurance claims. In addition, he has represented lenders, borrowers, title insurance companies and lienholders in real estate litigation matters, such as quiet title litigation, reformation, foreclosure and confirmation, lender liability litigation, lien priority disputes and similar matters.

Prior to joining Taylor English, Mr. Schultz was a partner at Gambrell & Stolz, LLP (now Baker, Donelson, Bearman, Caldwell & Berkowitz, PC), where he practiced law from 1998 until 2005 and received his “AV” rating from Martindale-Hubbell, the highest possible rating. Prior to attending law school, Mr. Schultz practiced as a certified public accountant with Deloitte & Touche, LLP, where he performed audit and tax services for real estate clients, and was a controller for Carter, an Atlanta-based real estate developer.

Mr. Schultz has authored the following publications: “Commercial/General Liability Coverage of Faulty Construction Claims," 33 Tort and Ins. L.J. 257 (1997) and "Statutory Deconstruction: An Examination of Critical Legal Studies in Context," 26 Cumberland Law Review 459 (1996). In addition, Mr. Schultz has authored a number of publications for the State Bar of Georgia’s Institute for Continuing Legal Education.  In 2011, he authored and spoke at a State Bar of Georgia Continuing Legal Education seminar on Insurance Coverage for Faulty Construction Claims and at the annual meeting of the Georgia Trial Lawyer’s Association on the subject of Insurance Coverage for Business Torts.

  • Lead counsel in connection with insurance and indemnity claims arising from the construction of a distribution warehouse in the State of Pennsylvania. Dispute involved pursuit of subcontractors and their insurers for defense and indemnity. The claims at issue exceeded $14 million. Retained by carrier for general contractor to pursue contribution claims against subcontractors and their insurers. The case involved litigation in three states and was settled on favorable terms and with substantial contributions on behalf of subcontractors and their general liability insurers.
  • Defense counsel for general contractor and developer of condominium project in Alabama, retained by carrier for general contractor. The claims at issue exceeded $1 million and were brought by home owners and condo association and involved water intrusion and numerous alleged construction defects. In a related case, pursued subcontractor and other CGL insurers for contribution. Both cases were settled at mediation with contribution from other CGL carrier.
  • Lead counsel in connection with litigation arising from alleged defective construction at a warehouse distribution facility in the State of Texas. Dispute involved general liability carrier for general contractor and general liability carrier for numerous subcontractors. The claims at issue exceeded $4 million. The case involved multiple motions for summary judgment and one appeal. The case was settled on favorable terms at mediation.
  • Lead counsel in connection with claims of defective construction at a manufacturing plant in the State of Alabama. Dispute involved claims in excess of $5 million that resulted in litigation with subcontractors and their general liability insurers as well as dispute with general contractor’s general liability insurer. The case was settled on favorable terms.
  • Lead counsel in connection with claims of defective construction at a $70 million distribution warehouse in the State of North Carolina. Dispute involved general liability carrier for general contractor and general liability carrier for numerous subcontractors. Assisted general contractor in settling claim and recovering in majority of settlement amount from clients’ insurance carriers and from third-party insurers.
